    Frequently Asked Questions

    What is the Nice Classification?

The Nice Classification is the international classification of goods and services for trademark registration, established by an agreement concluded in Nice, France in 1957. China adopted its goods section in 1988 and its services section in 1993, and joined the agreement in 1994.

How are the 45 classes divided?

Classes 1 to 34 cover goods, such as Class 9 electrical and scientific apparatus or Class 25 clothing. Classes 35 to 45 cover services, such as Class 35 advertising and business management or Class 42 technology services. Together they contain over ten thousand standard items.

Can one trademark cover several classes?

It can, but each class requires a separate application and official fees are charged per class. To obtain exclusive rights in several classes you must file in each of them.

What are the official filing fees?

The CNIPA trademark registration fee is 270 yuan per class for online filing, covering 10 items of that class with each additional item charged 27 yuan, and 300 yuan per class for paper filing, with each additional item charged 30 yuan. These are official fees only and exclude agency service charges.

What is a similar group, and why choose one first?

The similar group is how China's Classification of Similar Goods and Services groups comparable goods or services. Items in the same group are in principle considered similar, which is the basis for prior-mark searches and similarity findings, so you choose the class, then the group, then the specific items.

What happens if I choose the wrong class?

Trademark rights cover only the goods or services actually registered. Choosing the wrong class leaves your real business unprotected and allows others to register an identical or similar mark in that class. Base the choice on your actual business and near-term plans.

How many items should I select?

Each class fee covers 10 items, and extra items are charged individually. Base your selection on actual business and near-term plans, neither omitting core items nor filing large numbers without a genuine intent to use.

How long does trademark examination take?

By law the trademark authority completes examination within 9 months of receiving the application. The approved mark is then published for a 3-month opposition period, and if no opposition is filed registration is granted and the certificate issued.

How long is a trademark valid, and how do I renew it?

A registered trademark is valid for 10 years from the date of registration. Renewal must be filed within the 12 months before expiry; if that window is missed a 6-month grace period applies, after which the mark is cancelled.

What happens after I submit my selection here?

A ZHIHAIYIDA consultant checks the classes and similar groups you selected, searches for prior marks, and contacts you to confirm before filing. This page collects requirements only, and registration remains subject to CNIPA examination.
