Paying Patent Annuities in China: Deadlines, Late Fees and Lapse Risk — with Zhihai Yida’s Free Annuity Monitoring Service

An invention patent application in China typically takes two to three years and tens of thousands of yuan in fees and effort before grant. Yet a patent can “die” the moment a Notice of Termination of Patent Right arrives — and the reason is neither that the technology was invalidated nor that the patent was revoked: someone simply forgot to pay an annuity for one year.

Such losses share three features: the amount is small (a few hundred to a few thousand yuan a year), the consequence is severe (the patent right is lost outright, in most cases irreversibly), and the occurrence rate is far from low (once a company holds dozens of patents, relying on memory almost guarantees mistakes). This article explains the annuity payment rules, the consequences of late payment and the remediation windows in one place, and introduces the free annuity monitoring service our firm has long provided — turning this task from “relying on memory” to “relying on a system”.

1. What annuities are: prepaid annually, starting from the year of grant

An annuity is the official fee a patent holder pays each year to keep a patent in force during its term. It differs from the filing fee and the substantive examination fee paid at the application stage: filing fees are one-off, annuities recur every year, and the amount rises in steps as the patent ages.

Here is the point most easily misunderstood: annuities are prepaid, not paid “after the year has run out”. The statutory wording is that they “shall be paid before the expiry of the preceding year” — in other words, the annuity for year 2 must be paid before year 1 ends, not when year 2 is over. The vast majority of missed-payment accidents stem from holders assuming “paying at the end of the year is fine”.

2. Three deadlines you must not confuse

Milestone Rule
Year of grant Pay within 2 months of receiving the Grant Announcement and Registration Notices. If not paid (or not paid in full) by the deadline, the applicant is deemed to have abandoned the right to obtain the patent.
Every year after grant Pay before the expiry of the preceding year (prepaid annually). No separate official reminder is sent; the holder is expected to pay on their own initiative.
Expiry of the payment window Tied to the filing date — the annual payment deadline falls on the anniversary of the filing date. If that day is a statutory holiday, it rolls over to the first working day after the holiday.

In other words, every patent has its own “annual anniversary” determined solely by its filing date. A company with dozens of patents therefore has dozens of different deadlines scattered across the calendar — precisely the scenario in which manual ledgers fail.

3. How much per year: the official annuity schedule

Annuities are charged by patent type and by year band; the older the patent, the higher the fee (a deliberate design that encourages early abandonment of low-value patents and lowers the cost of maintaining valuable ones). Current official annuity fees in China (CNY per year):

Patent type Year band and annuity (CNY/year)
Invention Years 1–3 900|4–6 1,200|7–9 2,000|10–12 4,000|13–15 6,000|16–20 8,000
Utility model Years 1–3 600|4–5 900|6–8 1,200|9–10 2,000
Design Years 1–3 600|4–5 900|6–8 1,200|9–10 2,000|11–15 3,000

Keeping one invention patent alive for its full 20-year term costs nearly CNY 82,000 in annuities alone. If it lapses in year 11 through a missed payment, more than a decade of annuities and the entire filing investment sink at once — which is exactly why “reminders” are not an expense worth cutting.

Fee reduction: don’t pay more than you have to

Qualifying applicants and patent holders may request a reduction of annuities — a policy benefit that is frequently overlooked:

Item Details
Fees that can be reduced Filing fee, substantive examination fee (invention), re-examination fee, and annuities for the first ten years from the year of grant
Conditions Individuals: average monthly income of the previous year below CNY 5,000 (CNY 60,000/year). Enterprises: taxable income of the previous year below CNY 1,000,000. Public institutions, social organisations and non-profit research institutes also qualify.
Reduction rate A single applicant (patent holder): 85% reduction; two or more applicants: 70% reduction
Prerequisites and timing A fee-reduction filing must be completed first via the CNIPA Patent Business Handling System; the reduction request must be filed at least 2.5 months before the payment due date. Late requests are not accepted.

Note that reductions apply only to fees that are not yet due, and the request window is strict. Many companies think of applying for fee reduction only when a payment notice arrives — by which time the window has usually closed.

4. What happens after a missed payment: a three-stage timeline

A missed deadline does not mean instant lapse. The system provides a buffer — but the buffer is one-off and has a hard end point. The consequences unfold in three stages:

Time Patent status What must be paid
Less than 1 month overdue Grace period Pay the annuity only; no surcharge
1–6 months overdue Grace period Annuity + surcharge (5% of the full annual annuity for each month overdue; e.g. 10% for 2 months)
6 full months overdue, still unpaid Patent right terminates (as of the date the annuity payment window expired) A separate restoration procedure is required
Within 2 months of receiving the Termination Notice Restoration may be requested Restoration request fee CNY 1,000 + annuity + surcharge (calculated at 25% of the full annual annuity upon restoration)
Beyond the above deadlines The right is irreversibly lost; the technology enters the public domain —

Boil this table down and two sentences remain: six months is your window to pay up, two months is your window to restore. The surcharge is not a “fine” — it is a countdown signal. What is truly fatal is the window closing: after that, no amount of money brings the right back.

One more point is often overlooked: once a patent terminates, all filing fees, agency fees and years of official fees already paid are sunk, the technical solution enters the public domain where anyone may freely use it, and it cannot be recovered by filing again (the prior publication destroys novelty). This is an asymmetric loss: a small sum of money versus the entire investment.

5. Why missed payments are almost inevitable

In practice, missed payments are rarely caused by negligence in attitude; they are caused by structural factors:

First, volume and dates scatter simultaneously. A portfolio of dozens or hundreds of patents has deadlines spread across the calendar by each filing date; any manual ledger that is not updated religiously will drop entries. Second, staff turnover. The departure of the admin or IP officer responsible for payments, with a broken handover, is the most common accident trigger. Third, notices go astray. Official notices or agency reminder emails are sent to a decommissioned mailbox, or land in spam. Fourth, agency changes or exits. When switching service firms the handover is unclear and each side assumes the other is watching; if the previous agency has itself been deregistered, the gap can be total (see our firm’s statistics on Chinese patent agency exits). Fifth — and most important — the system has no “second reminder”. Paying annuities is the holder’s own duty; what arrives after a missed deadline is not a reminder but a termination notice that has already taken effect.

The conclusion is clear: this is not a job for memory and goodwill. It is a job for an automated, always-on system that does not depend on any one person.

6. The Zhihai Yida free annuity monitoring service: outsource the remembering

Hefei Zhihai Yida Patent Agency (General Partnership) has turned this “small chore” into a permanent, completely free public service: the Zhihai Yida Patent Annuity Monitoring System. It covers invention patents, utility models and designs in mainland China, automatically tracks each patent’s annuity deadline, and proactively reminds holders at key milestones, helping to avoid surcharges and lapse. The interface supports Chinese, English and Japanese.

What it does for you

Capability Details
Monitor on submission Start with just patent/application numbers + an email address; no technical documents required. Irregularly formatted numbers are recognised and normalised automatically.
Official data source Core data comes from CNIPA’s official Patent Business Handling System (cponline.cnipa.gov.cn); officially published information prevails.
Staged email reminders Reminders at 60, 30, 7 and 1 day before the deadline; follow-up notices every 30 days after expiry — you never have to remember to check.
Self-service dashboard A single view of totals, patents in good standing, and items due or at risk; each patent shows its title, applicant, legal status, next deadline, amount due and a countdown, expandable to the full multi-year payment plan.
Two password-free entrances The receipt email and every reminder email carry a personal dashboard link — one click, no login (the link contains a token and is device-independent; bookmark it). Alternatively, use the WeChat official account “Zhihai Yida” → menu “Annuity Dashboard” → log in with an email verification code, with a “remember this device” option.
Legal-status aware “In force / granted / maintained”: normal reminders. “Awaiting restoration / restorable”: reminders continue (the right may still be saved). “Terminated / expired / lapsed / abandoned”: reminders stop — no noise.

Free — but know the limits

① What “free” covers. The service is entirely free of charge; but “free” means annuity monitoring and expiry reminders only, and does not constitute legal advice or a guarantee of payment. Paying annuities on your behalf is a separately commissioned paid service, and you are of course free to pay directly in CNIPA’s official system. ② Quotas. To allocate resources fairly, one email account may monitor up to 100 patents linked to up to 5 applicants; for larger portfolios, submit with additional email accounts or contact us for batch management. ③ Coverage. Currently invention patents, utility models and designs in mainland China; patents outside the mainland (including Hong Kong, Macao and Taiwan, China) are not covered for now. ④ Data. Deadlines, amounts and legal status follow CNIPA’s official data; system estimates are for reference only. Reminders may be delayed or missed due to data sync latency or email filtering — please also watch for official notices and the patent register. ⑤ Use of your information. Patent numbers, email addresses and phone numbers you submit are used only for monitoring, reminders and dashboard login; the data is stored on our firm’s servers and is not disclosed to third parties.

7. Get started in three steps

Step 1 — Submit your patents. Open the Annuity Monitoring page on our website (zhihaiyida.com/en/fee-watch-en/), enter the patent numbers (required; multiple numbers separated by commas or Chinese enumeration marks), your email (required, for reminders and dashboard login), a phone number (required on the Chinese page, optional on the English/Japanese pages) and the applicant name (optional), complete the simple arithmetic check and submit. For bulk entry, click “Batch Upload” on that page to download a CSV template, fill in the four columns and upload — up to 100 patents at a time. You will receive a receipt email containing your personal dashboard link.

Step 2 — Open the dashboard and check the status. Click the dashboard link in the receipt email (no login needed) and bookmark it. Alternatively, in the WeChat official account “Zhihai Yida” → menu “Annuity Dashboard” → enter your email → request and enter a 6-digit verification code. Annuity data is fetched from CNIPA and usually appears within 1–2 working days; a card marked “pending” means the data is queued — reminders are not affected. For a detailed walkthrough of the dashboard, see the Annuity Monitoring Service · User Guide.

Step 3 — Do nothing. From then on, the system emails you at every payment milestone and keeps following up after any missed deadline. On the Chinese-language page a phone number is required so that, near a deadline, a personal call can serve as a second safety net alongside email.

FAQ

Q: Is this service paid?
A: Completely free. Our firm provides patent annuity monitoring as a long-term public service at no charge; “free” covers monitoring and reminders only, and does not include payment on your behalf.

Q: How soon after submission will I see annuity data?
A: Your patents enter the monitoring queue immediately. Data is fetched from CNIPA and usually appears on the dashboard within 1–2 working days.

Q: Why does the dashboard show “pending”?
A: CNIPA’s website restricts automated access, so data is fetched manually. “Pending” means the fetch is queued; the card updates automatically when done, and reminder emails are not affected.

Q: How many reminders will I receive?
A: By default, emails at 60, 30, 7 and 1 day before the deadline, followed by a notice every 30 days after expiry until payment is completed or the right terminates. Reminder schedules can be adjusted on request.

Q: Will the dashboard link still work on a new phone or computer?
A: Yes. The dashboard link contains a personal token and is device-independent; from a new device, the WeChat route requires a fresh email + verification code login.

Q: How many patents can I monitor?
A: Up to 100 patents and 5 applicants per email account; for larger portfolios, contact us for batch management.

Q: Will the information I submit be made public?
A: No. Patent numbers, email addresses and phone numbers are used only for monitoring, reminders and dashboard login; the data is stored on our firm’s servers and is not disclosed.

Q: How do I cancel monitoring or stop the reminders?
A: Reply to any reminder email, or write to patent@zhihaiyida.com stating the patent numbers or email address to remove; reminders stop once verified.
