A rejected patent, an invalidated trademark, a refused information disclosure—when an act of China’s National Intellectual Property Administration (CNIPA) harms your rights, litigation is often the first thing that comes to mind. But before going to court, there is usually a faster, lower-cost route: administrative reconsideration. At the end of 2024, CNIPA revised the CNIPA Administrative Reconsideration Rules, effective 1 February 2025. Many only notice the word “Rules,” yet it directly decides where your remedy window is, how to file, and who may represent you.
Why revise the Rules
- The revised Administrative Reconsideration Law took effect on 1 January 2024, and the 2012 Rules needed alignment.
- After institutional reform, CNIPA gained jurisdiction over trademark and geographical-indication reconsideration cases, which the old Rules did not cover.
- Some newly adjusted IP regimes (e.g., pre-reconsideration requirements) lacked corresponding remedy rules and needed adaptive amendment.
Revision process and effective date
The revision was not done behind closed doors: from 7 February to 9 March 2024, the draft was published for public comment, with broad consultation of relevant ministries, judicial authorities, and provincial IP administrations. The revised version was promulgated by CNIPA Decree No. 82 on 30 December 2024 and took effect on 1 February 2025. The revised Rules contain five chapters and 44 articles.
Four revisions worth noting
- Clear principles, duties and safeguards: the Rules state that reconsideration adheres to the leadership of the Communist Party of China and define the principles of performing reconsideration duties, with strengthened safeguards.
- Broader scope and pre-reconsideration range: administrative acts subject to reconsideration are enumerated, and the pre-reconsideration scope is clarified (for non-disclosure of government information, inaction, and on-the-spot penalties, you must first apply for reconsideration).
- Optimized acceptance and adjudication: material requirements are specified, applications may be filed via designated online channels, and summary vs. ordinary procedures are distinguished.
- Stronger dispute resolution and oversight: mediation is allowed, and the application of decisions such as revocation, confirmation of illegality, confirmation of invalidity, and alteration is detailed.
