Why enterprises need an IP “coordinator”
Many Chinese enterprises hold valuable patents yet struggle to find a commercialization path, or lack a “coordinator” to connect upstream and downstream IP resources along the industrial chain. China’s National Intellectual Property Administration (CNIPA) recently issued the Interim Guidelines for the Building and Management of Industrial Intellectual Property Operation Centers (Trial) precisely to solve such “hard-to-commercialize, hard-to-connect” problems.
1. Why the Guidelines were issued
Since 2017, CNIPA has guided the establishment of a batch of industrial IP operation centers, now a key part of China’s IP operation system. In 2024, together with seven other ministries, CNIPA issued measures to “guide the building of industrial IP operation centers” and launched the drafting of these Guidelines to strengthen overall coordination, graded construction and standardized management.
2. Core framework: “one main line, three considerations, five duties”
1) One main line
Focus on the industry, pool resources, integrate forces, and provide efficient support—covering traditional-industry upgrading, emerging-industry growth and future-industry cultivation; aggregating technology, data, IP, talent and capital; organizing government, industry, academia, research, finance and service parties; and supporting high-quality industrial development.
2) Three considerations
Balance different actors (leading enterprises, research institutes, parks, associations), different levels (national and local), and different stages (a closed loop of build–accredit–manage–evaluate, with dynamic entry and exit).
3) Five duties
The center shall mainly: build a coordinated-development mechanism, support industry–academia–research cooperation, conduct matchmaking for commercialization, advance patent industrialization, and provide professional services.
3. Main content: 6 parts, 18 articles
The Guidelines cover general provisions, main duties, basic conditions, accreditation management and service guarantees, with emphasis on positioning, service targets and transition arrangements.
Basic conditions for national centers: the host is generally a leading enterprise, a research institute with strong R&D, a national-level industrial park, or a national industry association; it must have dedicated organization, space, staff and funding; and it is evaluated on tangible results in patent commercialization,盘活 of existing patents from universities/research institutes, and SME services.
Accreditation management: CNIPA and local IP authorities manage centers by tier, with clear naming, accreditation procedures, dynamic management and disqualification rules; self-established branch centers are prohibited.
4. Three things industrial players should watch
Seize the policy dividend: centers serve the whole chain—public-interest services for SMEs plus market-oriented premium services.
Use the “patent pool / innovation consortium” mechanism: “big hand leading small hand” drives large, small and medium enterprises to develop in synergy, sharing patent risk and cooperation benefits.
Watch accreditation and exit: performance evaluation with entry and exit means you can prepare early to apply for the first batch of national centers.
